Terms & Condition

Effective Date: November 27, 2025

These Terms and Conditions ("Terms") govern the provision of window and door replacement, sales, and installation services by Cedar Hill Window Replacement ("Company," "we," "us," or "our") to the customer ("Client" or "you"). By requesting an estimate, scheduling a consultation, or entering into a service agreement with us, you agree to be bound by these Terms.

1. Services Provided

Cedar Hill Window Replacement provides comprehensive services including, but not limited to:

  • Consultation and Estimation: Providing professional advice, product selection guidance, and detailed written estimates for the project.
  • Product Sales: Supplying new windows, doors, and related materials.
  • Installation: Professional removal of existing units and installation of new windows and doors at the Client's specified property.

2. Estimates and Pricing

  • Validity: All written estimates are valid for a period of 30 days from the date of issuance, unless otherwise noted. Pricing is subject to change after this period due to fluctuations in material costs or labor rates.
  • Scope of Work: The final price is based strictly on the detailed scope of work outlined in the written estimate or contract. Any additional work requested by the Client outside of the original scope will require a written Change Order, which must be signed by both parties and may incur additional charges.
  • Unforeseen Conditions: The estimate assumes standard installation conditions. If unforeseen structural or hidden issues are discovered during the project (e.g., termite damage, concealed rot, mold), we will halt work, notify the Client immediately, and provide a revised quote to address the necessary repairs before proceeding.

3. Order and Payment

  • Deposit: A non-refundable deposit, typically 50% of the total project cost, is required to confirm the order, procure materials (windows/doors are custom-ordered), and secure an installation date.
  • Custom Orders: Once the deposit is paid and the order is placed with our supplier, the order cannot be canceled or modified without incurring potential additional fees from the manufacturer.
  • Final Payment: The remaining balance is due immediately upon the completion of the installation and the Client's inspection of the work.
  • Late Payment: Payments not received within the agreed-upon timeframe may be subject to a late fee of 1.5% per month or the maximum rate allowed by Texas law.

4. Cancellation and Refunds

  • Cancellation Before Order: If the Client cancels the contract before the custom windows or doors have been ordered from the manufacturer, the deposit will be returned, minus any costs incurred for surveys, permits, or design work.
  • Cancellation After Order: If the Client cancels after the custom order has been placed, the deposit is non-refundable to cover the costs of the custom materials, which cannot be restocked or reused.

5. Installation and Project Timeline

  • Scheduling: Installation dates are estimates only and are subject to change due to factors outside of our control (e.g., material delays, severe weather, unforeseen installation difficulties). We will communicate any significant changes promptly.
  • Client Responsibilities: The Client is responsible for:
  • Ensuring clear and unobstructed access to the work area.
  • Removing all personal items, furniture, and window treatments (blinds, curtains) from the immediate work area.
  • Providing a safe, well-lit, and accessible work environment, including access to standard utilities (electricity and water).
  • Property Damage: We take reasonable care to protect the Client's property. We are not responsible for minor dust, debris, or normal wear and tear to surrounding surfaces caused by the necessary performance of work. We are not liable for damage to existing fixtures or window/door treatments the Client failed to remove.

6. Warranty and Liability

  • Manufacturer Warranty: All windows and doors are subject to the original manufacturer's warranty. We will provide copies of the specific product warranties upon request.
  • Workmanship Warranty: We offer a one-year limited warranty on the quality of our installation workmanship, effective from the date of completion. This warranty covers defects resulting directly from our installation process (e.g., leaks due to improper sealing).
  • Exclusions: Our warranty does not cover:
  • Damage caused by misuse, abuse, neglect, accident, or acts of God (e.g., storms, floods).
  • Normal wear and tear.
  • Damage caused by foundation movement or structural settlement.
  • Repairs made by third parties.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, and any disputes arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
